Councilor files perjury raps

A criminal complaint for perjury was filed yesterday against a former city employee and for subordination of perjury against the Sangguniang Panlungsod secretary before the City Prosecutor’s Office by Bacolod Councilor Caesar Distrito.

The case for perjury was filed against Orlando Torre, who witnessed for SP Secretary Nilo Alejandrino in the administrative case filed against the SP Secretary involving a “chair-throwing incident” at the SP Secretariat Office.

Distrito had filed an administrative complaint against Alejandrino at the Office of the Vice Mayor and a criminal complaint before the Ombudsman in the Visayas

In his complaint-affidavit, Distrito said although Alejandrino was earlier given the chance to submit his comment/counter-affidavit before the Office of the Vice Mayor, he refused to do so, and was therefore declared to have waived his right to submit it.

He said Alejandrino was subsequently meted a preventive suspension pending the final investigation by the disciplining authority or vice mayor.

He added that Alejandrino was then given another chance to submit its answer/counter-affidavit on the formal charge of the disciplining authority.

Distrito said, considering that nobody in the SP office will testify and affirm the alibi of Alejandrino that he never shouted invective words towards him, that he never insulted and vilified and ridiculed his disability, that he never challenged him to a fight, and that he never threw a chair, but instead claimed that it just slipped from his hand, he therefore found it hard to look for someone who will execute an affidavit.

He said Alejandrino again failed to submit a comment/counter-affidavit during the formal charge and instead filed a motion for an extension of time.

Distrito said Alejandrino later found Orlando Torre to execute an affidavit, despite the fact that he was not there when the incident happened on October 24, 2011 at the SP Secretariat Office.

He said there are witnesses who can also attest that Torre was indeed not present when the incident happened, and therefore his statement made under oath is a clear falsehood and a big lie.

Alejandrino procured Torre to swear falsely, thus he is charged for subornation of a perjury, Distrito said.

Alejandrino could not be reached for his comment as of press time last night.*CGS
