The Department of Environment and Natural Resources has issued a memorandum stating that endorsements, licenses, clearances from national agencies and local government units are not prerequisites for the processing of Environmental Compliance Certificate and Certificates of Non-Compliance.
Jonathan Bulos, acting Chief Legal and Environment Education Division head of the DENR- Environmental Management Bureau, said this was their basis for issuing the Bacolod Imperial Court Inc. in Brgy. 6, Bacolod City Environmental Compliance Certificate R6-0910-309-9820 on Oct. 22, 2009.
However, he also said DENR Memo circular no. 2007-2008 issued on July 13, 2007 states that the issuance of an ECC for a project under Environmental Impact Statement System does not exempt the proponent from securing other government permits and clearances required by other laws.
The memorandum states that the findings and recommendations of the Environmental Impact Assessment will be integrated by relevant government agencies in their decision before clearances, permits and licenses are issued under their mandates.
Ed Hechanova of the Bacolod Imperial Court Inc. had requested the DENR-EMB to comment and act on the construction and operation of the motel project relative to the Sangguniang Panlungsod Resolution 732, Series of 2010, endorsing to DENR its letter/application.
Bulos, in his letter dated Jan. 7, 2011, said their office has issued the ECC based on the memorandum from the Environment Secretary dated Sept. 28, 2009 with the subject “New Processing Periods for the Environmental Impact Assessment System and corresponding guidelines no. 5, which states that endorsements are not pre-requisites to the issuance of an ECC or CNC.”*CGS
