SP has authority
over  brgy head


Interior and Local Government City Director Cherryl Tacda said the Sangguniang Panlungsod has jurisdiction over administrative complaints against a barangay captain, who is also a member of the SP being president of the Liga nga mga Barangay, if the case filed is related to his or her function as barangay captain.

The letter dated Sept. 30 to the SP of Tacda was in response to a query from the SP whether it has jurisdiction over a barangay captain who is at the same time a member of the City Council.

A complaint had been filed against Barangay Tangub captain and Councilor Noli Villarosa, for allegedly displaying his firearm while maligning a government employee in the barangay last month.

Villarosa’s act was captured on video that showed him shouting at complainant, Susima Taquiso, 53, of Villa Esperanza in the barangay, and maligning an employee of the Department of Environment and Natural Resources, reports said.

Bacolod Vice Mayor Greg Gasataya said yesterday that the DILG communication was received by Councilor Ana Marie Palermo as chairman of the Committee on Laws that will hold a conference on the DILG opinion.

Gasataya said that, based on the DILG opinion, Villarosa is holding two functions - as barangay captain and as city councilor, so the SP has jurisdiction over the complaint against him.*CGS
