City administrator
acquitted of perjury

Silay City Administrator Ignacio Salmingo was acquitted of perjury charges by Judge Eunice Tan Cuansing, after the prosecution failed to prove his guilt beyond reasonable doubt.

Cuansing, who is the Silay Municipal Trial Court in Cities judge, also ordered the release of a P6,000 cash bond to Salmingo.

The perjury charges against Salmingo, were filed by former Silay City Mayor Edwin Velez based on a newspaper report that alleged that the complainant kicked Hector Ilon, the messenger of the counsel of the accused, and punched a certain Marilo Alvarez.

In an eight-page decision, Cuansing said the prosecution failed to prove that there was falsehood in the averments of the accused. On the contrary, the evidence and testimonies of the witnesses were in accord with the assertions of the accused in his counter-affidavit, she added.

Thus, the third element of perjury is not attendant in the case, Cuansing said.

Perjury is the willful and corrupt assertion of a falsehood under oath or affirmation administered by authority of law on material matter, the judge also said.
